Please read these Terms carefully. They explain what Flight Booking Line does and doesn't do, and they limit our liability. The most important point: Flight Booking Line is not an airline. We are an independent service that connects you, by phone, with travel agents who can help you book, change or cancel flights. Your booking is with the airline, and it is arranged through the travel agency that helps you.
1. Agreement to these Terms
These Terms of Service ("Terms") are an agreement between you and BookaBiz, trading as Flight Booking Line ("Flight Booking Line", "we", "us" or "our"). They govern your use of:
- our website at flightbookingline.com and any page that links to these Terms (the "Site"); and
- our phone line, (833) 844-1215, and any other number we advertise (the "Line").
Together we call these the "Services". By using the Site or calling the Line, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.
2. We are not an airline
Flight Booking Line is an independent travel booking service. We are not an airline. We are not affiliated with, endorsed by, sponsored by or operated by any airline, and we do not act on behalf of any airline. We cannot see or change an airline's internal systems except through the normal booking tools available to travel agencies.
If you want to speak to an airline directly, for example about a booking you made with that airline, contact the airline through its official website or the contact details on your ticket. Airline names, logos and trademarks belong to their owners. Any mention of them is only to describe the flights we can help with.
3. What our Service does
When you call the Line, your call is answered by us or connected to an independent travel agency partner ("Partner"). Partners are separate businesses. They can:
- search for and book new flights;
- help you change or cancel existing bookings, as the fare rules allow;
- explain fare options, fees and the rules that apply to your ticket; and
- help with group, last-minute and multi-city trips.
We may receive a fee from Partners when we connect calls to them. This does not change the price you are quoted. Partners set their own prices and service fees, and they must tell you about them before you pay.
We do our best to connect you with a Partner who can help, but we can't guarantee that a Partner will be available at every moment, or that a particular fare, flight, seat or outcome will be available.
4. Who can use the Services
You must be at least 18 years old and legally able to enter into contracts to use the Services or make a booking. If you book for other travellers, you confirm that you have their permission to do so, that you have authority to accept these Terms and the applicable fare rules for them, and that you will share relevant information with them.
5. Bookings, prices and fees
Who you contract with
When you make a booking, you enter into a contract with the airline (for carriage) and with the Partner that arranges the booking (for its services). Flight Booking Line is not a party to those contracts unless we expressly tell you otherwise on the call. The airline's conditions of carriage and fare rules, and the Partner's terms, apply to your booking.
Prices and availability
- Fares are set by airlines and can change at any time until your ticket is issued. A quoted fare is not guaranteed until payment is taken and the ticket is confirmed.
- The total price may include airline fares, taxes, government fees, carrier-imposed charges, optional extras (such as bags or seats) and the Partner's service fee. The agent must give you the total price, including any service fee, before you pay.
- Some charges, such as checked bags or seat selection, may be payable directly to the airline later.
Payment
Payment is taken by the Partner or the airline, not by Flight Booking Line. Your card statement may show charges from the airline, the Partner, or both. Please check your statement and ask the agent on the call if you are unsure how charges will appear.
Check your details
Before you pay, check that every traveller's name exactly matches their government ID, and that the dates, times, airports and fare type are correct. Fixing errors after ticketing may cost money or may not be possible. Read your confirmation as soon as you receive it and contact the Partner immediately if anything is wrong.
6. Changes, cancellations and refunds
- Fare rules apply. Whether you can change or cancel a ticket, and what it costs, depends on the airline's fare rules and conditions of carriage. Many low fares are non-refundable, or allow changes only for a fee plus any difference in fare.
- Service fees. A Partner's service fee for booking, changing or cancelling is set by that Partner. It must be disclosed before you pay, and it may be non-refundable even if the ticket is refunded.
- Refunds. Refunds of airline fares are made by the airline in line with its policies and applicable law, and can take time to process. Where the airline cancels or significantly changes your flight, you may be entitled to a refund under US Department of Transportation rules. Nothing in these Terms limits those rights.
- 24-hour rule. US Department of Transportation rules give certain rights to cancel or hold a reservation within 24 hours of booking, for bookings made at least seven days before departure. Ask the agent how these rights apply to your booking.
7. Travel documents and requirements
You are responsible for making sure that every traveller has valid travel documents (such as passports, visas and any required ID) and meets all entry, exit, health and transit requirements for each country on the itinerary. You are also responsible for arriving at the airport in time. Agents may give general information as a courtesy, but you should confirm requirements with official government sources. We and our Partners are not responsible if a traveller is refused boarding or entry because of documents or requirements.
8. Calls, recording and communications
- Calls to the Line may be monitored and recorded by us, our service providers and Partners, for quality, training, billing, fraud prevention and dispute resolution. Where required by law, you will hear a notice. By staying on the line, you consent to the recording.
- Standard call charges from your phone carrier may apply. Our number is toll-free within the United States.
- Calling the Line does not sign you up for marketing calls or texts. See our Privacy Policy for details.
- Please be respectful to agents. We and our Partners may end calls that are abusive, threatening or fraudulent.
9. Acceptable use
You agree not to:
- use the Services for any unlawful, fraudulent or abusive purpose, including making bookings with stolen payment details;
- make spam, automated, robocall or repeated nuisance calls to the Line, or call it to generate calls for payment;
- impersonate any person, or give false information when booking;
- interfere with or disrupt the Site, including by introducing malware, scraping or overloading it; or
- copy, resell or commercially exploit the Services without our written permission.
10. Partners and other third parties
Partners, airlines and other travel suppliers are independent businesses. They are solely responsible for their own services, prices, fees, bookings, refunds, conduct and compliance with the law. That includes any seller-of-travel registration or bonding requirements that apply to them. To the fullest extent permitted by law, we are not liable for the acts, errors, omissions, representations, warranties or negligence of any Partner, airline or other supplier. That includes flight delays, cancellations, schedule changes, overbooking, lost baggage, injury or other events that happen during travel.
If you have a problem with a booking, contact the Partner that made it or the airline first. If you can't resolve it, contact us at [email protected] with the phone number you called from and the date of the call. We will try to help where we reasonably can.
11. Our content and trademarks
The Site and its content, including text, design, graphics and the Flight Booking Line name and logo, are owned by us or our licensors and protected by intellectual property laws. You may view the Site for your personal, non-commercial use. You may not copy, modify, distribute or create derivative works from it without our written permission. Third-party names and trademarks belong to their owners and do not imply any affiliation with or endorsement of us.
12. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, that any Partner will be available, or that any particular fare, flight, seat, schedule or outcome will be obtained. Information on the Site is general and may change without notice.
Some jurisdictions don't allow certain warranties to be disclaimed, so some of these disclaimers may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Flight Booking Line and its owners, officers, employees, agents and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or travel or holiday enjoyment, arising out of or related to the Services, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for all claims arising out of or related to the Services or these Terms is limited to the greater of (a) the amount you paid directly to Flight Booking Line, if any, in the 12 months before the claim arose, and (b) US $100.
These limits apply whatever the legal theory of the claim. They do not limit liability that cannot be limited by law, such as liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by our negligence. Some jurisdictions don't allow these limits, so they may not apply to you.
14. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Flight Booking Line and its owners, officers, employees and agents from any claims, losses, liabilities, damages and costs (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
15. Disputes and governing law
- Talk to us first. Most concerns can be resolved quickly. Before starting any formal claim, please email [email protected] describing the issue and the outcome you want. Give us 30 days to try to resolve it informally.
- Governing law. These Terms are governed by the laws of Victoria, Australia, without regard to conflict-of-law rules. This does not take away any protection you have under the consumer protection laws of the state where you live.
- Where claims are heard. Either party may bring an individual claim in small claims court where it qualifies. Otherwise, claims will be heard in the courts of Victoria, Australia, unless the law of your state of residence gives you the right to bring the claim there.
16. Changes to the Services and these Terms
We may change, suspend or discontinue any part of the Services at any time. We may also update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Changes apply from the date they are posted, and they do not affect bookings already made. If you keep using the Services after a change, you accept the updated Terms.
17. General terms
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Services.
- Severability. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent permitted, and the rest of these Terms will remain in effect.
- No waiver. If we don't enforce a provision, that does not waive our right to enforce it later.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example as part of a sale of our business.
- Events outside our control. We are not liable for delays or failures caused by events beyond our reasonable control, such as telecommunications outages, natural disasters, pandemics, strikes or government action.
- Survival. Sections that by their nature should continue after you stop using the Services will continue. These include sections 10 to 15 and 17.
